I think it's silly to make him out to be a bad guy because he wants to stay dead.

I tend to see it as the other way around. The afterlife is the prison. In the Marvel Multiverse, the living universe is where everything happens and where the ultimate fate of everything is decided. The afterlife is where spirits go to be nothing, inconsequential, and worthless.

I'm not making him to be the bad guy. He's doing that by himself. By staying dead, he's giving the finger to anyone he ever cared about. They often say heroes are the people that run towards danger while others flee. By staying dead he is fleeing, and forfeits his hero-ship. He is weak. He's a coward.

And this started before he even died. Whenever I think back on the Death of Mar-Vell, I'm reminded of the Dylan Thomas poem about going gently into that good night. Well, he did. He should have been raging against the dying of the light. And he should be still raging.

To throw another heroic quote out there: "I only regret that I have but one life to lose for [insert anything here]." In the Marvel Multiverse, you don't have just one life. So you're damned for staying dead. And you deserve that damnation.

But I don't hold Mar-Vell totally accountable, because I tend to see Marvel's afterlives as one huge mindscrew that exists only to manipulate the living.
