Think about it like a very good, close, NBA game... Both sides might have the lead at some point. There are cool moments throughout the game- BUT the end is where is it most exciting!

Equal? Cap's side have virtually left themselves in a do or die situation in Tony's own HQ while Tony has the entire government on his side, SHIELD, the Pro Reg heroes, the Thunderbolts and clones and a large section of the media.

And don't start with the vast power difference between the two sides- name five Secret Avengers who can go toe to toe with She Hulk, Bishop, Doc Samson, Radioactive Man and Fixer? And by that I mean poentially to the death. Pretty hard, once you exclude Cap, Cage, Hercules and Hulkling and Wiccan, who will likely be engaged with the others.
