Unless his death-rebirth-death-rebirth-Wandascrew changed something in him, there is really no way he would join up with the Mighty Avengers. He hated what the Avengers had become by being too politically affiliated. He's likely see Tony's plan as no different than the way things were before. Janet being on the team just might be enough to keep him away, as well.

Note how when he resurfaced after House of M, he went to Dr. Strange. He hasn't bothered saying "Boo" to anyone else that we know of. Besides Wanda.

I really don't see him taking the role of Cap. I think he might find those shoes a bit too hard to fill.

Funny thing there, I see Janet (and Natasha) as the only things that might have him choose the "Mighty" Team. He's often been one to follow his um.. "litte arrow"

I sorta agree, but I've been wondering why he wasn't written into Civil War. I hope is wasn't so his record would be clean for him to join the Mighty Avengers. (It's a cinch that if he had been around, he would have choosen Cap over Tony.)

Trouble is, he would probably think is sacrilige for anyone else (with the possible exception of Winter Soldier) to take over the role either. IIRC, that was part of the reason he hated USAgent so much. So he might take the mantle if it meant keeping someone else from it.
