Thunderbolts #9 was the issue they had it out (it's on Marvel Unlimited if that's something you do: http://marvel.com/digital_comics/issue/2287/new_thunderbolts_2004_9)

On the second point I'm actually curious about that now too. Carol Danvers was the Thunderbolts Government liaison during the early issues of "New Thunderbolts" so you'd think it would have at least come up. But I don't specifically remember anything about it.
