Interesting legal question but IIRC, Emma was never pardoned for killing that bodyguard Firestar befriended, so if Emma tries a "Phoenix made me do it" defense, they can always just charge her with the bodyguard's death.

They don't even know she killed Randall Chase. Good luck charging her with that. I wouldn't think they could charge her with any of her crimes when she was Hellfire Queen. If they could have, they would have already.

Emma told Angel Randall was killed by Selene, and then he later turns up dying and talking about about Emma was lying to her. Angel would have to be a complete idiot not to realize Emma was responsible.
In addition, Kitty witnessed Emma kill three of her goons in Uncanny 129. I always assumed that Kitty and Angel could have sent Emma to jail at any time but they decided not to testify as long as Emma behaved herself.

Emma has no morals. She could have made people forget what she's done, seeing how she goes from being from the most powerful telepath in the world to No 3 or No 4, depending on the writer.

This ruse has worked for a lot of telepathic types.
