That's a flaw originating from the original comic version of the story. It never did make any sense that Cap would be the scofflaw. An American solider is trained to submit to authority. And Steve in particular believes in government and the rule of law.

Tony, as a right-wing capitalist, would be more likely to believe in small government, and maximizing personal freedoms. Much like his stance in Iron Man 2, when he refused to share his tech with the American government.

Cap might be suspicious of intelligence services, especially since Hydra infiltrated SHIELD, but the UN represents many legitimate governments. For him to say no to them is like saying no to a direct order from the President. The Cap I know wouldn't do that. Tony and Reed would.
