-- Scarecrow's Scarebeast days would have counted either way.
-- As of the recent Resurrection storyline, Ra's spirit apparently returns from actual death by mystical means.

Other meta-Batfoes (albeit comparatively minor ones) might include:

-- Blockbuster I and II (deceased)
-- Charaxes (deceased)
-- The Outsider (probably non-continuity)
-- Gentleman Ghost (deceased but unbothered by it; had a brief stint as a regular Bat-foe)
-- Ten-Eyed Man (deceased; pathetic)

And if we get into the reams of one-off 1950s "sci-fi" villains like the Element Man or the Zebra-Men, the various villains unique to Batman's team-ups in World's Finest Comics and Brave and the Bold, and so on, we get into the hundreds....
