I am going to guess registered and I have faith Brubaker to come up with a good reason as to why which is character driven like all of the story I have read by him thus far.

If it's Bucky then I'd hope that they go the route they went with Falcon: registered with some form of independence, where he is given the liscense and is granted legality as a hero but is only loosely associated with the Initiative. I wouldn't mind that as much as seeing him marching on to Camp Hammond. Besides, that would be a good way for him to represent ALL of American, pro and anti (to some extent) registration
