The deleted scene thing brings to mind a question I've long had about the metas.

Is what we see them standing in all there is to each cell? Makes no sense. Where do they lay down? Where do they...well...GO THE BATHROOM?

Season two should really clarify this. It just looks strange. If they were being kept in suspended animation, that'd be one thing, but they're not. HOW can they be living in those little chambers?

Indeed there are some unanswered questions about the prison cells they have set up.

Also one must wonder what would happen when the District Attorney learns of it. She has seen the video evidence of the shape shifter that framed Eddie and admitted the law isn't quite up to dealing with meta humans and their powers.

So she MIGHT realize that Star Labs was the only place set up to contain them. As long as they had amenities such as plumbing, food/water, and the cells were at least moderately comfortable they really can't press a human rights violation charge.

They could however still go after them for not being cops and taking the law into their own hands, but again who else could have contained the metas? No one. A regular prison won't work, and given the huge plan the Trickster recently tried, perhaps he should be locked up in the pipeline too.
