I refuse to buy this stuff (it's ALMOST over!) and I'm no fan of the Punisher, but you're spot on here. Castle would never have survived as long as he has if he were incapable of assessing a situation like you describe in the book this way. The only thing that comes to mind that would rectify it is if the villains you mention were going to reveal something that he didn't want out of the bag. Otherwise it's not what makes him what he is.

I think this scene was intended to discredit Cap's side a bit. It's a counter to the criticism against the pro-reg side - they use villains, while Cap throws in with the Punisher (and the Kingpin, per War Crimes). Tony's side was responsible for Goliath's death, Cap's side was responsible for the death of these two villains. The Punisher is an easier target than Tony, after all, and look how they've dragged Tony through the mud. There's enough bad characterization to go around.
