In America, a government agency still has to approve of mergers. Depending on the type of business it is, approval comes from the Justice Department, Federal Communications Commission, Federal Trade Commission, etc.

If DC and Marvel were to merge, I think it has a great chance of getting approval. Marvel and DC would argue that they are licensing companies, meaning they would compete with things like Disney, Nickoloden, sports, Warner Brothers, General Motors, etc.

Even looking at comics, Marvel and DC only combine for 70% of the sales in comics. Marvel and DC would then argue they still have to compete with other comics (anime/magna), books, other forms of entertainment, etc.
