That's the unclear part. Sometimes we were told that any superhero had to join SHIELD/the Initiative. Sometimes we were told that any person with superpowers had to join SHIELD/the Initiative or go to jail.

So for instance, Cloud 9 had to join the Initiative and be on one of the 50 State teams, she didn't have a choice. Her story was tragic in the sense that she didn't want to be a superhero, only wanted to fly.

Jessica Jones (and others like Firestar) had the option of not being an active superhero.

But one consistent factor is that if you had powers, you had to register. We aren't sure if they have to join the Initiative as active members, what exactly "registration means", and various other issues.

    This must have been addressed at some point in the comics, considering how much of a difference it makes in terms of what the SHRA actually is- the former option makes it basically just a gun license for superhuman powers, while the latter option is tantamount to slavery like Luke Cage said.

Yeah, it's not your fault. The portrayal of the SHRA has been completely inconsistent. Marvel should have just came out with the official terms a long time ago.
