Along with the rest of the 5,876 new titels marvel has 2 new titles that are based on DC charecters:
Squadron Supreme - justice league
Hiperion - Superman
NightHawk - Batman

sure it's a diffrent names, costumes and even attitudes. but it's still a thinly vailed copies.

do they have the Moral right to publish a line based on their rivel properties?

They are not truly copies. If there the slightest thing wrong with it, DC would be in court.
