Along with the rest of the 5,876 new titels marvel has 2 new titles that are based on DC charecters:
Squadron Supreme - justice league
Hiperion - Superman
NightHawk - Batman

sure it's a diffrent names, costumes and even attitudes. but it's still a thinly vailed copies.

do they have the Moral right to publish a line based on their rivel properties?

I see no real failing in exploiting Nighthawk and Hyperion as they are but two in a sea of Batman/Superman analogues that are present throughout comics. Where I think it does become a bit much is the idea of an ongoing Squadron Supreme series rather than a mini-series, if Marvel push such a series hard then it is clearly intended as a direct rival to DCs JLA and Earth-2 books and even using a writer well known for his work on both, and that is pushing it too far in my view. Both companies copy from the other, but they should restrain from blatantly cloning a cast of characters and setting them up as a mirror group in their own book just to give the finger and antagonise...

Having said that I am certainy intrigued by James Robinson's involvment. He turned Earth-2 into an overnight success, he can do the same for the Squadron.
