Also another reason why Osborn is popular is that once the T-Bolts left Colorado, they immediately went to Wasington. TV camera crews captured the team (including Osborn, wielding a gun) fighting off the Skrulls. Osborn noticed this, and saw this as a perfect opportunity to play up the fact that he and his team went to protect the President while other heroes were in NYC. Plus, he also mentioned that his Colorado base had no Stark tech (it had Osborn tech).
As for the whole murder thing, I'm sure he afforded the best lawyers and had them convince a jury that he was innocent and that he was framed by someone.
