Well even if Peter as "killed" it wouldn't stick. After all Ben turned to dust and was revived.

As to trademarking the name and fighting Miles, well it is likely not something Peter would do, but Ben isn't Peter

As to setting up Ben, well they need a plot reason for Peter to suit up again.
